TERMS OF SALES

Article 1: SCOPE

Vins du monde et d'ailleurs (hereinafter collectively the "Seller") has set up an electronic commerce service available on the Internet at the following address: www.vinsdumondeetdailleurs.fr  (hereinafter the "Site") intended for consumer customers (hereinafter the "Customer (s)"), that is to say any natural person who acts for purposes that do not fall within the scope of the part of its commercial, industrial, craft or liberal activity.

Article 2: ACCEPTANCE OF THESE GENERAL CONDITIONS OF SALE

In the absence of specific stipulations agreed in writing between the parties, all orders placed on the Site are automatically subject to these general conditions of sale, which prevail over any other document, such as prospectus, press, catalogs or e-mailing. issued by the Seller, which are only indicative.

Any use of the Site and / or placing an order implies having previously consulted and accepted all of these general conditions of sale.

Vins du monde et d'ailleurs reserves the right to adapt or modify these general conditions of sale at any time. In case of modification, the general conditions of sale in force on the day of the order will be applied to each order.

 

Article 3: OFFERS / RATES / ORDERS

All our wine offers are valid while stocks last, excluding promotions, special offers and gifts. The prices are expressed in Euros, all taxes included. Considering the rare or speculative nature of certain products, we reserve the right to apply restrictions on the quantities available, or even to refuse or cancel an order that is clearly abnormal.
Gift cards are valid for 1 year and are valid throughout the site.
Our offers are exclusively reserved for consumer customers, and in no case to professional resellers. Orders are confirmed by sending the invoice but are only final upon receipt of full payment of the price of the goods.

 

Article 4: TERMS AND CONDITIONS OF PAYMENT

Article 5: DELIVERY

DELIVERY DELAY :

Our preparation time is normally 1 to 2 working days.

UPS Access Point delivery times are 2 to 3 working days; Mondial Relay's are 3 to 5 working days. 
Home delivery times are 1 to 3 working days.
These deadlines do not engage our responsibility but only that of the carriers. Also, delivery time overruns cannot give rise to damages.

In the highly unlikely event that elements beyond our control extend the period beyond 30 days, he can obtain the refund within 5 working days by sending an email to contact@vinsdumondeetdailleurs.fr.

COST OF TRANSPORT:

The transport options and associated costs are visible by clicking on the link shipping costspresent on each product page and in the basket.

COST INSURANCE:

It guarantees reimbursement within 10 working days of the purchase in the event of breakage, loss or theft of the package. Insurance costs are included in the cost of transport.  

RECEIPT OF GOODS :

The goods travel under cover of the transport regulations in force. For the handling of a dispute (breakage, missing items, damage), the reservations must be precise, characterized and stipulated on the transport document at the time of delivery and be immediately reported to us by email (24 hours) so that we can report it to the carrier by LR within 3 days of receipt. Without this notification, the insurance cannot play, even if it has been taken out.

Warning ! : Forms of the type "subject to unpacking" are automatically void.

DELIVERY ADDRESS :

Check that the delivery coordinates are precise and exact, indicate if possible, the phone number or numbers where you can be reached.

Article 6: WITHDRAWAL PERIOD

You have the right to withdraw from this contract without giving any reason in a fourteen day period. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods. The Customer may also, at his express and written request, exercise his right of withdrawal from the conclusion of the contract. If it is a contract for several goods ordered by means of a single order and if these goods are delivered separately, the period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last asset.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example, letter sent by post or e-mail) to the following coordinates: Auxime, Vins du Monde et d 'ailleurs, 9 quai Jean Moulin, 69001 Lyon;  Email: contact@vinsdumondeetdailleurs.fr

In order for the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of withdrawal : In the event of your withdrawal from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from the fact that you have chosen, where applicable, a delivery other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any event, the reimbursement method chosen will not incur costs for you. We may withhold reimbursement until we have received the item or until you have provided proof of shipment of the item, whichever is the earlier.

You must return or return the goods to the address which will appear on the header of your Vins du monde et d'ailleurs invoice without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract. This period is deemed to have been met if you return the goods before the expiration of the fourteen day period.

You will have to bear the direct costs of returning the goods (a flat rate of 15 euros excluding tax to which is added on average 2.5 euros excluding tax per bottle for metropolitan France).

The Customer is only liable for the depreciation of the goods resulting from handling other than those necessary to establish the nature, characteristics and proper functioning of these goods.

Article 7: PRESERVATION OF ORGANOLEPTIC QUALITIES OF WINE

  • Vinottes:

The vinotte bottler guarantees that the organoleptic qualities of the vinotte wine are preserved for 3 months after packaging. There is perfect traceability of the vinotte date thanks to the batch number. If during your tasting, you feel that the organoleptic qualities have been compromised, communicate the batch number written on the vinotte to contact@vinsdumondeetdailleurs.fr

We will verify the date of shipment of the vinotte. If this date is later than 3 months after vinotte, we will send you a replacement vinotte without delay at our expense.

If the date of shipment occurs less than three months after vinotating, we will test with the supplier the organoleptic qualities of the reference sample. If it is confirmed that there was a problem with the vinotte, we will send you a set of 6 vinottes of your choice at our expense.
 

  • Corked bottles:

Liability for corked bottles lies with the property (or merchant) designated as the bottler. In the event of a corkage taste, the procedure is as follows: return the bottle (full or almost) and its original cork to us with an accompanying letter stipulating the purchase from our company. Upon receipt, we address the complaint to the property (or merchant) concerned who will judge the merits of the request and decide whether or not to replace it. Upon receipt of the response we will let you know and in the event of a positive decision we will proceed with the replacement offered by the property (or dealer).

Article 8: Protection of minors

In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited. The Customer declares and agrees to be of legal age for drinking alcoholic beverages on the date of the order.

Article 9: Health warning

Alcohol abuse is dangerous for your health, please consume in moderation.

Article 10: Visuals

The photos appearing on the site are communicated for illustrative purposes and without contractual value. We invite you to refer to the description of each product to know the precise characteristics.

Article 11: Protection of files and intellectual property

All content on this Site (texts, images, photos, graphics, logos, icons) are protected by copyright. Any use or reproduction, even partial, of the Site or its contents is strictly prohibited without the express authorization of its author.

Article 13: Amicable settlement of disputes

In the event of difficulties in the application of these general conditions of sale, we invite you to seek an amicable solution by contacting our Customer Service in advance. In accordance with the provisions of articles L 611-1 and R 612-1 et seq. Of the Consumer Code concerning the amicable settlement of disputes, if you have sent a written complaint to the professional and you have not obtained satisfaction or a response within within two months, you can submit your complaint free of charge to the consumer ombudsman. Article 14:  Applicable law and competent jurisdiction

These general conditions of sale are subject to French law. In the event that one of the clauses of these general conditions of sale is null and void, this can in no way affect the validity and compliance with these general conditions of sale. In the event of a dispute that arises following or during the placing or execution of an order, the competent French court will be appointed in accordance with the rules of common law.
