TERMS OF SALES

Article 1 : CHAMP D’APPLICATION

Vins du monde et d’ailleurs SAS (hereinafter collectively the “Seller”) has set up an e-commerce service available on the internet at the following address: www.vinsdumondeetdailleurs.fr  (hereinafter the "Site") intended for consumer customers (hereinafter the "Client(s)"), i.e. any natural person who acts for purposes that do not fall within the framework of his commercial, industrial, artisanal or liberal activity.

Article 2: ACCEPTANCE OF THESE GENERAL CONDITIONS OF SALE

In the absence of specific stipulations and agreed in writing between the parties, all orders placed on the Site are automatically subject to these general conditions of sale, which prevail over any other document, such as prospectuses, press, catalogs or e-mailing. issued by the Seller, which have only an indicative value.

Any use of the Site and/or placing an order implies having previously consulted and accepted all of these general conditions of sale.

Wines of the world and elsewhere SAS reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order.

 

Article 3 : OFFERS / PRICES / ORDERS

All our wine offers are valid while stocks last, excluding promotions, special offers and gifts. Prices are expressed in Euros, all taxes included. Considering the rare or speculative nature of certain products, we reserve the right to apply restrictions on the quantities available, or even to refuse or cancel an order presenting a manifestly abnormal character.
Gift cards are valid for 1 year and are valid throughout the site.
Our offers are exclusively reserved for consumer customers, and in no case for professional resellers. Orders are confirmed by sending the invoice but are only final upon receipt of full payment of the price of the goods.

 

Article 4 : TERMS AND CONDITIONS OF PAYMENT

Payment for goods is made in full when ordering.

Article 5: DELIVERY

DELIVERY DELAY :

Our lead time is normally 1-2 business days.

UPS Access Point delivery times are 2 to 3 working days; those of Mondial Relay are 3 to 5 working days.
Home delivery times are 1 to 3 working days.
These deadlines do not engage our responsibility but only that of the carriers. Also, exceeding the delivery time cannot give rise to damages.

In the highly unlikely event that elements beyond our control extend the period beyond 30 days, he may obtain a refund within 5 working days by sending an email to contact@vinsdumondeetdailleurs.fr.

COST OF TRANSPORT:

Transport options and associated costs are visible by clicking on the linkshipping costspresent on each product page and in the basket.

COUT ASSURANCE :

It guarantees reimbursement within 20 working days of the purchase in the event of breakage, loss or theft of the package. Insurance costs are included in the cost of transport. For the exact conditions of the insurance, see the section "shipping policy"

RECEIPT OF GOODS :

The goods travel under cover of the transport regulations in force. For the management of a dispute (breakage, missing items, damage), the reservations must be precise, characterized and stipulated.on the transport documentat the time of delivery and be immediately reported to us by email (24 hours) so that we can be able to report it to the carrier by LR within 3 days of receipt. Without this report, the insurance cannot play, even if it has been taken out.

Attention ! :Formulas of the type "subject to unpacking" are null and void.

Article 6 : WITHDRAWAL PERIOD

You have the right to withdraw from this contract without giving any reason withinfourteen day period. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods. The Customer may also, at his express written request, exercise his right of withdrawal from the conclusion of the contract. If it is a contract relating to several goods ordered by means of a single order and if these goods are delivered separately, the period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good.

For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal: In the event of your withdrawal from this contract, we will reimburse you for all payments received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen, where applicable, a method delivery other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the refund using the same means of payment as you used for the initial transaction, unless you expressly agree to a different means; in any case, the method of reimbursement chosen will not incur any costs for you. We may withhold reimbursement until we have received the goods or until you have provided proof of shipment of the goods, whichever date is first.

You must return or return the goods to the address that will appear on the header of your Vins du monde et d'ailleurs SAS invoice without undue delay and, in any event, no later than fourteen days after you have communicated to us your decision to withdraw from this contract. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.

You will have to bear the direct costs of returning the goods (a flat rate of 15 euros excluding tax to which is added an average of 2.5 euros excluding tax per bottle for metropolitan France).

The Customer's liability is only engaged with regard to the depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these goods.

Article 7: PRESERVATION OF THE ORGANOLEPTIC QUALITIES OF WINE

  • Mignoneheads:

The preservation of the organoleptic qualities of the wine are guaranteed for 7 days after packaging. This conditioning is carried out on the day of dispatch. The means of transport offered allow delivery in 48-96 hours. As a result, the organoleptic qualities are guaranteed for 48 hours from the date of reception of the mignonettes. If during your tasting, you believe that the organoleptic qualities have been compromised, immediately send an e-mail to contact@vinsdumondeetdailleurs.fr. 

The date of sending the email is authentic to determine if the tasting took place within 48 hours of receipt. If this is the case, we will send you a replacement minfo without delay at our expense.

  • Corked bottles:

Responsibility for corked bottles rests with the property (or merchant) designated as the bottler. In case of cork taint, the procedure is as follows: return the bottle (full or almost full) and its original cork to us with an accompanying letter stipulating the purchase from our company. Upon receipt, we send the complaint to the property (or trader) concerned who will judge the merits of the request and decide whether or not to replace it. As soon as we receive the answer, we will let you know and in the event of a positive decision, we will proceed with the replacement offered to us by the property (or dealer).

Article 8: Protection of minors

In accordance with article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited. The Customer declares and undertakes to be 18 years old on the date of the order.

Article 9: Health warning

Alcohol abuse is dangerous for your health, consume in moderation.

Article 10: Visuals

The photos appearing on the site are communicated for illustrative purposes and without contractual value. We invite you to refer to the description of each product to find out its precise characteristics.

Article 11: Protection of files and intellectual property

All content on this Site (texts, images, photos, graphics, logos, icons) is protected by copyright. Any use or reproduction, even partial, of the Site or its contents is strictly prohibited, except with the express authorization of its author.

Article 13: Amicable settlement of disputes

In the event of difficulties in the application of these general conditions of sale, we invite you to seek an amicable solution by first contacting our Customer Service. In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes, if you have sent a written complaint to the professional and you have not obtained satisfaction or an answer within two months, you can submit your complaint free of charge to the consumer mediator. Article 14 :  Applicable law and competent jurisdiction

These general conditions of sale are subject to French law. In the event that one of the clauses of these general conditions of sale is null and void, this can in no way affect the validity and compliance with these general conditions of sale. In the event of a dispute arising following or in connection with the placing or execution of an order, the competent French court will be designated in accordance with the rules of common law.
