ARTICLE 1: OBJECT

The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.

ARTICLE 2. PARTIES

This shipping policy is applicable between Wines from around the world and elsewhereSAS, capital social : 1 000 €, registered with the RCS of Lyon in France the 11/01/2023, under the number 947 970 927, registered office: 23 chemin des combes, 69370 Saint Didier au Mont d'or, France, telephone: +33 6 71 94 08 19, email : Contact@vinsdumondeetdailleurs.fr, Intra-community VAT number : FR57947970927, hereinafter "the Publisher" and any person, natural or legal, private or public law, registered on the Site to purchase a Product, hereinafter "the Customer".

ARTICLE 3. DEFINITIONS

« Client » : any person, natural or legal, under private or public law, registered on the Site.

« Site Contents » : elements of any kind published on the Site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases or software.

« The Editor » : AUXIME/Wines from around the world and elsewhere, SAS taken in its capacity as publisher of the Site.

« Internet user » : any person, natural or legal, under private or public law, connecting to the Site.

« Product » : property of any kind sold on the Site by the Publisher to Customers.

« Site » : website accessible at URL vinsdumondeetdailleurs.fr, as well as related subsites, mirror sites, portals and URL variations.

ARTICLE 4. CHAMP D’APPLICATION

The Site is open and free to all Internet users. Browsing on the Site implies acceptance by any Internet user of this shipping policy. The simple connection to the Site, by any means whatsoever, in particular via a robot or a browser, will imply full acceptance of this shipping policy. When registering on the Site, this acceptance will be confirmed by ticking the corresponding box.

The Internet user acknowledges by the same fact that he has read them fully and accepts them without restriction.

Ticking the aforementioned box will be deemed to have the same value as a handwritten signature on the part of the Internet user. The Internet user recognizes the proof value of the Publisher's automatic registration systems and, except for him to provide proof to the contrary, he waives the right to contest them in the event of a dispute.

This shipping policy is applicable to relations between the parties to the exclusion of all other conditions, and in particular those of the Internet user.

Acceptance of this shipping policy assumes on the part of Internet users that they have the necessary legal capacity for this, or failing that, that they have the authorization of a guardian or curator if they are incapable, of their legal representative if they are minors, or that they hold a power of attorney if they are acting on behalf of a legal person.

ARTICLE 5. DELIVERY

5.1. Shipping cost

The costs of delivery or provision will, in any case, be indicated to the Customer before any payment and only concern deliveries made in metropolitan France, including Corsica, in Belgium, in the Netherlands, in mainland Spain, in Portugal, in Italy, Germany, Austria, Ireland. For any other place of delivery, it will be up to the Customer to contact customer service.

The delivery costs indicated on the Site are understood to include packaging, in euros, all taxes included and are the only ones in force.

The delivery costs are indicated below for information only, the rates of the carriers, varying upwards and downwards over time. Only the prices displayed at the time of checkout are authentic.

5.2. Delivery time

Orders are delivered by Mondial Relay, UPS, UPS Access Point in a delay of 4 working days from the full receipt of the price by the Publisher.

Certain products or certain order volumes may nevertheless justify a delivery time longer than 4 open days. It will be expressly mentioned to the attention of the Customer during the validation of the order.

5.3. Damaged package

In the event of delivery of a clearly and visibly damaged package, it is up to the Customer to refuse it in order to benefit from the guarantee offered by the carrier. The Customer must also inform the seller without delay, so that the broken bottles are reimbursed or, insofar as the wines are still available, the replacement bottles are prepared, then shipped upon receipt of the damaged return package. It should be noted that if the labels of a bottle in the package have been soiled by the breakage of another bottle in the package, the bottle will not be replaced, but a credit of 20% of the value of the bottle will be given to the customer, after sending photos showing the soiled label. In such a case, the delivery times indicated above in these general conditions will no longer apply.

5.4. Retention of title - transfer of risks

Ownership of the Products delivered is reserved for the Publisher until the Products are delivered to the Customer, notwithstanding any clause to the contrary, unless the parties have punctually and expressly agreed in writing to waive this clause.

The Customer bears the risks relating to the Products from the time of the order. Throughout the duration of the retention of title, the Customer must insure the Products belonging to the Publisher at his own expense against any damage that may occur and justify this to the Publisher at first request.

ARTICLE 6. STIPULATIONS FINALES

6.1. Applicable right

This shipping policy is subject to the application of French law.

6.2. Changes to this Shipping Policy

This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is that in force on the day of his order or his connection to this Site, any new connection to the personal space entailing acceptance, where applicable, of the new shipping policy.

6.3. Disputes

Pursuant to Ordinance No. 2015-1033 of August 20, 2015, all disputes with a Consumer Customer which may arise in the context of the execution of these general conditions and whose solution could not be found prior to the amicable agreement between the parties must be submitted to Medicys: www.medicys.fr.

Any dispute relating to or in connection with this contract shall be settled by arbitration in accordance with the rules of the Digital Institute of Arbitration and Mediation: www.fast-arbitre.com.

6.4. Wholeness

The nullity of one of the clauses of this contract will not entail the nullity of the other clauses of the contract or of the contract as a whole, which will retain their full effect and scope. In such a case, the parties must, as far as possible, replace the canceled stipulation with a valid stipulation corresponding to the spirit and the object of these presents.

6.5. Non-waiver

Failure by the Publisher to exercise the rights granted to it herein shall in no way be interpreted as a waiver of the assertion of said rights.

6.6. Languages of this Shipping Policy

This shipping policy is offered in French.

6.7. Unfair terms

The stipulations of this shipping policy apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair terms in contracts concluded between a professional and a consumer.
